Eddie Haskell Named KYGO-FM/Denver Program Director

Lincoln Financial Media announces that veteran radio programmer Eddie Haskell will return to the Denver market as Program Director at Country KYGO-FM, February 11. Haskell, until recently, was Operations Manager at the Cumulus Albuquerque cluster. He programmed the cluster's Country KRST-FM for nine years and was the station's afternoon host. Haskell had also supervised Country stations in the West region under previous owner Citadel. He previously was in the Denver market at KDJM-FM. "Eddie's impressive background programming both heritage country stations and format challengers taking on heritage brands makes him battle-tested," says LFM Denver SVP and General Manager Bob Call. "From helping to sign-on Young Country WYCD years ago to defending and building the success of a great heritage brand like KRST, Eddie is a proven programmer who will help guide KYGO going forward." Haskell adds, "I could not be more excited. KYGO is a legendary radio station and Lincoln Financial Media is one of the best companies in the industry. I can't wait to be back in the Mile High City and put KYGO on a nice upward trajectory." We just recently reported that Haskell was exiting the Cumulus five-station Albuquerque cluster. He's also been PD at KKAT-FM, Salt Lake City; WYCD-FM, Detroit; and WXLK-FM, Roanoke.




Ron Escarsega Named OM at San Francisco's KGO-AM/KSFO-AM

Veteran Los Angeles Talk programmer Ron Escarsega is joining Cumulus San Francisco All News KGO-AM and Talk KSFO-AM as Operations Manager, replacing Paul Hosley. Escarsega is the former Assistant PD at sister Talk KABC-AM, Los Angeles. He also spent many years at CBS Radio Talk KLSX-FM, Los Angeles. “I’m excited for the new challenge to work with two iconic stations KGO and KSFO. I appreciate the confidence Cumulus has shown in me and look forward to the new challenge," says Escarsega. Corporate News/Talk/Sports Program Director Jim Mahanay adds, “Ron has done a great job for us in Los Angeles. We’re excited at the skills he brings north to the Bay Area."



L.A.'s 'Uncle Joe' Benson Moving to 'The Sound' for Mornings

Veteran Los Angeles radio personality "Uncle Joe" Benson joins Bonneville Classic Rock "100.3 The Sound" KSWD-FM, Los Angeles, for mornings replacing the recently departed Larry Morgan and Sheri Donovan. Benson, who joins from afternoons at crosstown Cumulus Rock KLOS-FM, will debut "Uncle Joe's Rock and Roll Morning Show" February 4. "At The Sound, we consider our listeners to be family, and everyone's favorite Uncle belongs on The Sound," says Program Director Dave Beasing. VP and General Manager Peter Burton adds, "The Sound's mission is to connect with the people of Southern California through great Rock music. Nobody does that like Uncle Joe Benson. His addition cements The Sound's position as the area's leading Classic Rock station." And Benson tells us, "This is going to be so much fun! George Allen Named Clear Channel Raleigh Market Manager

Clear Channel Media and Entertainment Raleigh has named George Allen as Market Manager, effective immediately. As Market Manager, he is responsible for the entire Raleigh market’s operations including all strategies, programming and sales initiatives. Allen joins the Raleigh cluster from Clear Channel Cleveland, where since 2009 he's been Director of Sales. Marketers Shifting Focus from Traditional Media to Digital

Marketers plan to decrease their focus on newspapers, magazines and radio this year, looking more at various digital channels. That's according to a survey conducted by Aquent and the American Marketing Association (AMA). Radio is third for the decrease cited by 24% of respondents in the survey conducted online within the United States by Inavero on behalf of Aquent and the American Marketing Association among 2,620 marketing professionals. The survey was conducted between October 31 and November 19, 2012. MarketingCharts.com notes that traditional media occupied the top six areas slated for a decline in focus this year by respondents, who widely say they are moving more toward digital. "Topping the list is mobile media, with 82% of respondents saying they’ll increase their organization’s focus in this area. That aligns with recent research finding mobile to be perceived as the year’s most disruptive media and marketing trend. Recent survey results from Econsultancy also revealed that mobile is the most exciting opportunity for digital marketers this year. Meanwhile, many respondents to the Aquent and AMA survey also will increase their focus on social media (76%) and marketing automation (75%)."




Illinois Officially Enacts ‘First Informer' Status for Broadcasters

Illinois now has a new law ensuring that broadcasters have the emergency credentials in times of disaster to get fuel to power their facilities. The First Informer Broadcasters Act has been signed into law by Governor Pat Quinn. It applies to both broadcasters and cable operators will get expedited access to fuel needed to power their facilities’ emergency generators during times of disasters. Illinois Broadcasters Association CEO Dennis Lyle says, “Illinois’ brave first responders have always known they can depend on their dedicated local broadcasters to assist them in disseminating critical information to the masses, regardless of the disaster or emergency,” The “First Informer Broadcasters Act,” sponsored by Illinois State Representative John Bradley and Illinois State Senators Antonio Munoz and Kirk Dillard, passed in the House last Spring, and in the State Senate this month. Both votes were unanimous. With the Governor’s signature, the Act becomes effective immediately. The IBA (Illinois Broadcasters Association) now begins the process of working with the Illinois Emergency Management Agency in identifying and creating a training curriculum that broadcast and cable operator personnel will have to complete before earning emergency credentials, according to Lyle.

Jury Finds Bubba Not Guilty of Defamation

UPDATE: After a defamation trial that many saw as a First Amendment issue, Bubba the Love Sponge Clem (his legal name) has been found not guilty. After closing arguments were presented Wednesday, the Tampa jury found that Todd "MJ Kelly" Schnitt did not prove he was defamed by Bubba, and voted not guilty on all counts against Clem. The verdict didn't take long to come back. It came just about three hours after the case had gone to the jury following closing arguments. Our earlier report follows.

The civil lawsuit trial involving Bubba The Love Sponge Clem and Todd "MJ Kelly" Schnitt has now gone to the jury after closing arguments. Schnitt is suing Clem for alleged defamation from on-air comments when the two were competing in mornings in the Tampa radio market, which some say was nothing but a "good classic radio war." Schnitt's attorney told the jury in his closing statement that Bubba defamed his client on the air "out of sheer hatred." Bubba's lawyer Joseph Diaco, however, said in his closing argument that "No one goes to the Bubba the Love Sponge morning show to learn an objective fact. It's an entertainment show. It's a farce." The closing arguments followed nine days of testimony over the past three weeks, and the highly publicized DUI arrest of one of the key attorneys in the case, followed by accusations that the arrest was a setup from the other side. Knowledgable observers of the case note that as a public figure, Schnitt must prove there was "actual malice" -- that statements were made with knowledge that a statement is false or in reckless disregard for being true or false. Clear and convincing evidence must be shown that the plaintiff was harmed.

After the case went to the jury for deliberations, alternate juror Alana Wilshire was dismissed and spoke at length with the media. "I think MJ should put on his big girl panties and get over it," she told a TV station. "This is a waste of taxpayer money. I would rule in favor of Bubba. I wouldn't give MJ a dime!" Wilshire, along with other jurors, are prohibited from speaking to one another about the case while the trial is in progress. When asked if other jurors felt the same she said, "I don't know. We can't talk about it. I've been dying to voice my opinion." She said the trial has been a waste of time and pointed out that even she has been called names in the past. "MJ should get over it. When Bubba called MJ's wife a whore, it wasn't meant about Michelle, it was a way to get back at MJ. It was aimed at him."

Meanwhile, media reports say this is not Schnitt's first such lawsuit against a rival radio personality. In 1990 a Virginia jury awarded Schnitt, as MJ Kelli, $310,000 after he successfully sued rival Roy Jaynes, who used the on-air name D.B. Cooper. Both were then night hosts in the Norfolk, Virginia, market. Jaynes had made derogatory comments about Schnitt on the air, including calling him a "little homosexual Jew boy" and inviting listeners to testify on-air that Schnitt was gay. In that slander lawsuit, Schnitt asked for $3 million.




Nadine Santos Named '92.3 Now FM' New York APD/MD

CBS Radio CHR-Top40 "92.3 Now" WNOW-FM, New York, names Nadine Santos as its new Assistant PD/Music Director. She was previously APD/MD at crosstown Clear Channel Urban "Power 105.1" WWPR-FM, and Senior Manager of Programming for Music Choice. She starts at "92.3 Now" February 11. Says Program Director Rick Gillette, "The outpouring of interest in this position was gratifying. Some of the biggest names in the country raised their hand, and I spoke to almost every one of them over the past seven weeks, which is why this took a little longer than I had hoped. At a very early stage in the process it became clear that a New York state of mind was going to be a critical requirement of whoever got this job. Ohio's 'Q92' Apologizes for Host Mocking Caller with Down Syndrome

CHR-Top40 "Q92" WDJQ-FM, Canton, Ohio, apologizes for comments made by afternoon host Mo, which set off a furor and are said to have mocked a caller who it was discovered has Down Syndrome. The family of the caller is said to hope that publicizing the situation will "raise awareness of bullying of people with disabilities." The mother of caller Kellie Baker, who reached the station accidentally, tells media in the area, "My feeling is, if I can change the way one person thinks or feels, it would be phenomenal." According to TimesRegister.co, "The host of 'The MO Show' answered the phone. She thought she was speaking with her friend’s dad, " quoting the mother, Gigi Standiford. "The radio host kept Baker on the phone for several minutes, and then played a recording of their conversation on the air. Near the end, Mo asked her if she knew who he was. Baker answered, 'No'. 'Okay, so I can laugh at you and you won't know who to call and say you’re offended,' Mo said, and then laughed." The station has issued a statement through its attorney, saying:"Q92 and 'The Mo Show' would like to take this opportunity to reaffirm its support of efforts to raise awareness regarding the challenges faced by those with developmental disabilities. Specifically, the station wishes to sincerely apologize again for any actions or comments that could be construed as making light of the challenges faced by persons that are developmentally disabled or casting those persons in any humorous light. The station's policy is to treat our callers and listeners with the utmost respect, professionalism, and sensitivity." Nevertheless, multiple reports indicate this is not the end of the controversy.




Grammy Foundation Names Ryan Seacrest Honorary Board Chair

The Grammy Foundation has appointed Ryan Seacrest as Honorary Chair of the Foundation's Board. The Grammy Foundation, one of two affiliated charities of The Recording Academy, offers year-round music education programs for high school students and schools, as well as advancement, archiving and preservation, and grant-making programs to safeguard important collections and fund research at the intersection of music and science. Seacrest joins current Grammy Foundation Board Chairman and new venture backer Rusty Rueff; Vice Chair Tim Bucher, founder and CEO of TastingRoom.com and Silicon Valley-based entrepreneur; Secretary/Treasurer Geoff Cottrill, chief marketing officer of Converse; and Chair Emeritus Beatriz R. Perez, chief sustainability officer of the Coca-Cola Company, in leadership positions at the organization. "I speak for all of the officers and directors of the Grammy Foundation in wholeheartedly welcoming Ryan to our Board," says Neil Portnow, President/CEO of The Recording Academy and Grammy Foundation. NABOB Urging FCC to Not Allow Further Broadcast Ownership Consolidation

As the FCC continues its quadrennial review of its broadcast ownership rules, NABOB (National Association of Black Owned Broadcasters) again is urging the Commission to refrain from further relaxing any of its ownership rules, including broadcast-newspaper cross-ownership restrictions. NABOB says allowing further consolidation would come at the expense of minority broadcast owners or potential owners. In letters to FCC Commissioners, and in formal comments filed with the FCC, NABOB says, "If large radio group owners are now allowed to combine their multiple station ownership advantage with ownership of a daily newspaper, the group owner will be able to combine the radio and newspaper sales forces, and will be able to offer advertisers a combined radio-newspaper buy, which will leave minority owners even more disadvantaged in their efforts to compete in the marketplace." NABOB urges the Commission to complete the studies required by the Supreme Court in an Affirmative Action and Equal Protection ruling, which provide a basis for adopting new policies specifically designed to promote minority broadcast station ownership.




Cox Orlando Promotes Tammie McGrath to DOS

Cox Media Group names Tammie McGrath to be Director of Sales for its six-station Orlando cluster. McGrath is currently General Sales Manager of CMG's Orlando stations WCFB-FM and WWKA-FM. She's been with the cluster for seven years and has served as General Sales Manager, Local Sales Manager and Account Manager. "Tammie is a great leader and champion for our Cluster," says VP and Market Manager Susan Larkin. "I believe that this will give her the opportunity to continue to leverage her strengths." McGrath adds, "I appreciate the opportunity and support to grow this cluster. I look forward to collaborating with Susan and the sales leadership team to put some plans and processes in place that will help us continue to be successful in our market." Reporting to McGrath in her new role will be General Sales Managers JC Campese, Jimmy Farrell, and Ken Marks, along with cluster Director of Marketing Services Dina Pancoast, and the Cox Events Group team of Wes Halliwell and Dan Leaphart. McGrath will also continue oversight of WCFB-FM and WWKA-FM until her replacement is named.




SiriusXM to Offer Super Bowl with 12 Broadcasts in 9 Languages

SiriusXM Radio says that it will offer listeners comprehensive coverage of Super Bowl XLVII, with 12 different live broadcasts of the game in nine languages. On Sunday, February 3, at 6pm ET, SiriusXM will air Super Bowl XLVII live from the Mercedes-Benz Superdome, offering subscribers a choice between the team radio broadcasts of the AFC Champion Baltimore Ravens and NFC Champion San Francisco 49ers, plus the national radio broadcast and eight foreign language broadcasts. Subscribers who have SiriusXM Internet Radio access in addition to their satellite radio subscription can also listen to the game through the SiriusXM Internet Radio App for mobile devices and online at SiriusXM.com.

Sun City Cafe Radio Network Set to Launch in July

AVDeli expands its menu of broadcast services to include a new, long-form, creative programming division. The Sun City Cafe Radio Network will launch in July, headed by President David Hunter. The company says two new weekly syndicated radio shows are now in production and three more are currently in development. "The Sun City Cafe" will be produced before a live studio audience in Sun City, Arizona, featuring Classic Hits, Classic Comedy and Pop Culture flashbacks. The weekly three-hour show will be hosted by air personality and voiceover talent Joe Kelly and will also feature voiceover talent Kate West. "Notorious 90s" will be produced in Austin, TX and hosted by KLBJ Program Director and air personality LA Lloyd. That weekly two-hour show will be a Rock excursion through the last decade of the 20th Century. Hunter says he's now searching for a host for a new heavy metal show, "Metal Madhouse," that will feature "metal monsters from the 70s, 80s and 90s." Very Briefly ...

Mary Lou Gunn is set to begin as General Manager for Buckley's four Bakersfield stations -- KLLY, KSMJ, KNZR, and KKBB -- February 4. Gunn is moving to Buckley after 20 years in radio, most recently as VP/DOS for Univision’s San Francisco cluster. Prior to that she was VP/Market Manager for Clear Channel's Portland, Oregon, cluster. Buckley Radio President Joe Bilotta says, “We at Buckley Radio are thrilled to have someone of Mary Lou’s experience join us in this capacity. Bakersfield is a growing market and our four-station cluster will benefit from her considerable skill-set.”

CHR-Top40 "Z93" Conway/Myrtle Beach, SC, "will flip to a Southern Rock and Country mix on February 1 as '93.9 The Outlaw'," writes Lance Venta at RadioInsight.com. The station is currently owned by the Volt Radio Trust, created for divestiture of stations when Cumulus acquired Citadel.

CMP KC Corp., headed by Lew Dickey, has closed on Urban AC "Magic 107.3" KMJK-FM, Kansas City from AR Broadcast Holdings for $5.58 million, according to broker for the deal Patrick Communications. AR is headed by President Larry Patrick.

My Town Media has closed on its previously announced purchase of KIND-AM and FM, and KBIK-FM, Independence, Kansas, from the Receiver for Tallgrass Broadcasting for $310,000. My Town Media is headed by Bill Wachter and has other radio interests in Kansas and Arkansas. David Rhoades was the Court appointed Receiver for Tallgrass Broadcasting. The word of the closing comes from Bill Whitley of Media Services Group who served as the broker representing the Tallgrass Receiver.

Entravision Communications changes the name of its Lotus Entravision Reps to Entravision Solutions. The company says, "The new identity reflects the organization's ongoing investment in its marketing solutions, including expanded sales and marketing resources, and a focus on maximizing opportunities by leveraging the Entravision brand."

Katie Dombrowski returns to Coleman Insights as Communications Manager, 18 months after leaving to serve on the staff of a political campaign in North Carolina. "We are very excited to have Katie back on the Coleman team," says Coleman Insights President/COO Warren Kurtzman. "As Communications Manager, Katie will focus on all external communications and marketing for the company. Syndicated Radio Talk Host Charged in $10M Mortgage Fraud Case

A Chicago area attorney and national radio host who bills himself as the "people's attorney" has been charged in a $10 million mortgage fraud scheme, according to federal officials. Warren Ballentine has been indicted by a federal grand jury for defrauding lenders by scheming with others to obtain nearly 30 bogus mortgage loans, according to the U.S. Attorney's office in Chicago. His Chicago-based radio program is distributed nationally by Syndication One. On the Facebook page for his show, Ballentine has posted, "For the record I'm innocent. I made a standard fee on closings. In Illinois a buyers attorney doesn't handle any of the documents till closing so as this proceed u will see that I'm in this because I have a name. No big payday no knowledge of the paperwork. I know some may say everybody says their innocent. Well Iam if u ever bought a house how much you pay ur lawyer 500 bucks at the most what lawyer would be part of a scheme and make a standard fee? INNOCENT." The Chicago Tribune reports that according to prosecutors, Ballentine helped obtain nearly 30 mortgages in which buyers were fraudulently qualified for loans based on false documents. The schemes took place between December 2004 and May 2006, authorities alleged. He is scheduled to appear in federal court February 5 on six counts of bank fraud, false statements and mail and wire fraud.




Chicago's WBEZ-FM to Listeners: 'Go Make Babies'

Chicago Public Media's WBEZ-FM will ask its listeners to make more listeners starting February 1. They are calling the unique promotion their "2032 Membership Drive." The idea is to make babies now to create the next generation of listeners. WBEZ-FM will unveil its first new marketing campaign in ten years, reports Chicagoland Radio and Media. "Chicago Public Media hired local agency Xi Chicago (pronounced "Chee Chicago"), a digital marketing division of the Proximity Worldwide/BBDO network, to come up with a creative new advertising campaign. Xi Chicago did just that." CRM's Larz writes, "With tongue planted firmly in cheek, the new marketing campaign asks 'interesting' people to make a love connection with other interesting people, thus creating a new batch of interesting newborns, who will grow up to be interesting people themselves." The ad campaign will ask people to visit the website GoMakeBabies.com, which leads to a Facebook page and app. There, visitors can take an "Interesting Assessment," which will then provide links to current WBEZ-FM content based on their tastes, as well as trying to connect them with others who share similar tastes. We're told this will be an all-out campaign once it officially gets underway. The news of the coming campaign is receiving national mainstream media attention.




Northwestern College to Acquire Kansas City's KLJC-FM

Northwestern College of St. Paul, Minnesota, has agreed to acquire non-commercial Christian AC KLJC-FM from Calvary Bible College in Kansas City. The agreement also includes the station's translator in Emporia, Kansas. Terms were not disclosed. Says Calvary Bible College President Dr. James Clark, "Music and biblical teaching have been the trademark of KLJC, which has ministered to the Kansas City metropolitan area for 43 years. Over the years, the college has also trained more than 200 men and women, who are in Christian radio today, through a major degree program in Christian Broadcasting. Our desire is to see that same commitment for Christian radio to continue in the future." KLJC has been providing Christian programming to Kansas City since it signed on in 1970. Northwestern President Alan Cureton says, "Our Northwestern Media ministry exists to lead people to Christ and nurture believers in their spiritual growth. The model of 'high touch' listener and community engagement has effectively served our listeners in five states, and the addition of Kansas and Missouri to our roster is a responsibility and a privilege." Northwestern College owns 14 stations in Iowa, Minnesota, North Dakota, South Dakota, and Wisconsin. Brokered by Greg Guy of Patrick Communications, the transaction goes to the FCC for approval, which is expected within several months.




Dan Persigehl In Place as PD for Two Cumulus Kansas City Stations

Dan Persigehl is now in place at Cumulus Media Kansas City as Program Director for Classic Hits KCMO-FM and Adult Variety Hits "105.1 Jack FM" KCJK-FM, and co-hosting the "Jack" morning show, as "The Tall Guy." That show is now known as "Jenn and The Tall Guy." A brief early announcement of the new gig came earlier this month, and is followed by a full news release now that he's in place. Robert Little Joining NPR as Senior Editor for Investigations

NPR News has hired veteran investigative reporter and editor Robert Little to lead its investigative team, beginning March 4. Little will work with reporters, producers and editors to develop investigative stories, and will oversee NPR's partnerships with other non-profit news organizations doing high-level investigative work. "We have serious ambition for NPR's investigative work and Bob brings a powerful set of skills to the task. He has deep investigative experience and an impressive track record on that front," says NPR SVP of News Margaret Low Smith, "In addition, he has high level newsroom leadership know-how and broad domestic and international reporting experience." Little spent 15 years at The Baltimore Sun, where since 2010, he's been the Investigative and Enterprise Editor. Under Little's leadership, The Sun recently published a series of articles uncovering widespread flaws in Baltimore's speed camera network, which has since been shut down. Before that, his team created a unique database of tax records that exposed millions of dollars in improper discounts. Little also designed and launched the watchdog blog Sun Investigates, and oversaw the newsroom's training program for computer-assisted reporting, and ethics and libel law. As one of The Sun's senior editors, he managed the organization's main newsgathering departments and played a leading role in guiding all of its coverage and in planning the daily newspaper.




Cleveland Indians Sign New Deal with Clear Channel Cleveland

Clear Channel Cleveland announces a new five-year agreement with the Cleveland Indians for WTAM-AM to remain the "Flagship Home of the Cleveland Indians" through 2017, and for WMMS-FM to become the FM home of the Indians. WTAM-AM has carried Indians games on the radio since 1998. Under the new deal, WTAM-AM will air all regular season games and WMMS-FM will simulcast the majority of Cleveland Indians games. Clear Channel Cleveland will also air 15 live Spring Training games and will continue to distribute Tribe games to the entire Indians Radio Network, which consists of 26 stations across Ohio and Western Pennsylvania. "The Cleveland Indians are very excited to continue our 15-year relationship with Clear Channel Media and Entertainment for the next five years," says Cleveland Indians President Mark Shapiro. "We are always looking to expand the reach of Indians baseball and are excited to target a new and potentially younger audience on a regular basis by adding the FM simulcast component." Shareholder Sues to Stop Arbitron Sale to Nielsen

Arbitron shareholder Joseph Pace has filed a class action lawsuit seeking to halt the sale of the ratings company to Nielsen. The suit claims that a breakup fee and other terms of the deal prevent any competing offers to buy the company. Pace's suit claims that Arbitron's break-up fee of $32.7 million and a provision in confidentiality agreements signed by other bidders "ensure any legitimate bidder has been effectively shut out of the process." The lawsuit was filed in Delaware Chancery Court in Wilmington, Delaware. Pace is asking the court to stop Arbitron from closing the deal with Nielsen, until the company adopts procedures that will "obtain the highest possible price for shareholders." The complaint alleges that Arbitron's board breached their fiduciary duty by approving Nielsen's $48-per-share offer, in the deal announced in December, when Nielsen announced it had signed a definitive agreement to acquire Arbitron. Pace says in his court filing, "The proposed transaction is the product of a flawed process that is designed to ensure the sale of Arbitron to Nielsen on terms preferential to Nielsen, but detrimental to plaintiff and the other public stockholders of Arbitron. The proxy, which recommends that Arbitron shareholders vote in favor of the proposed transaction, omits and misrepresents material information about, among other things, the events leading up to the board's approval of the merger agreement and the financial analyses conducted."




Arbitron Suing Cleveland TV Station for Copyright Infringement

Arbitron has filed a lawsuit against WKYC-TV, Cleveland, claiming copyright infringement in the use of radio ratings. Arbitron alleges WKYC-TV improperly used its ratings data in a media kit. In the suit, Arbitron also says the TV station has stated that data involving Pandora audience listening estimates came from Arbitron, when it actually did not. Arbitron claims that "WKYC-TV has willfully and intentionally infringed Arbitron's copyrights by copying and distributing copyrighted audience estimates obtained from the Arbitron Reports and Databases without authorization from Arbitron. Moreover, WKYC-TV has infringed Arbitron's trademarks by willfully and intentionally using the Arbitron Marks in its promotional activities." Arbitron adds that the TV station's media kit, which is used for WKYC's sales presentations, "is part of an effort by WKYC-TV to sell advertising time on its station together with time on Pandora." The suit adds that "WKYC has falsely represented that certain audience estimates were produced by Arbitron when, in fact, those audience estimates were not produced by Arbitron, causing confusion in the minds of the public." Arbitron says it obtained a copy of the media kit, which the ratings company calls "a collection of promotional materials and PowerPoint slides used in sales presentations - distributed by WKYC-TV," adding that: "Upon information and belief, the Media Kit is part of an effort by WKYC-TV to sell advertising time on its station together with time on Pandora." The complaint says "WKYC has falsely represented that certain audience estimates were produced by Arbitron when, in fact, those audience estimates were not produced by Arbitron, causing confusion in the minds of the public."

Donovan McNabb Joins NBC Sports Radio

Newly retired NFL quarterback Donovan McNabb joins NBC Sports Radio as a contributor, according to an announcement from Dial Global and the NBC Sports Group. The six-time Pro Bowl quarterback began his career with the Philadelphia Eagles. He will serve as an NFL lead analyst for NBC Sports Radio shows throughout the week and will also call in weekly to affiliated stations. McNabb will also be part of NBC Sports Radio's programming features on Super Bowl Radio Row this week in New Orleans. Also, we're told, he "will play a big part in a soon-to-be-announced daily talk program, that will debut April 1 as the network expands its programming lineup. Classic Rock "100.7 The Bay" WZBA-FM, Baltimore, appoints Dan Michaels to be the station's new Program Director. He starts in Baltimore February 11. Michaels joins WZBA-FM after four years with AC "Q92.9" WLTJ-FM, Pittsburgh. "Dan Michaels brings a long track record of programming success and is clearly a very special talent. He has a true passion for radio and a deep understanding of how to build a powerful brand and connect that to listeners and advertisers," says General Manager Jefferson Ward. Schnitt Attorney Requests Mistrial, Claims DUI Was Set-Up

Todd "MJ Kelly" Schnitt's defamation lawsuit trial against Bubba The Love Sponge Clem resumed Friday (Jan. 25), with Schnitt's legal team asking for a mistrial. They claim their lead attorney, who was arrested on DUI charges, was set-up by the Clem team. No mistrial was declared Friday morning, and testimony in the high-profile case between two former Tampa morning radio rivals continued after Thursday's break because of the Wednesday night arrest of attorney Charles Philip Campbell Jr. Schnitt's attorneys claim that a legal assistant for the law firm representing Bubba, Melissa Personius, was with Campbell at the time of his arrest and that she got Campbell drunk at a restaurant and then called the police. They also allege that Personius never told Campbell that she worked for Bubba's law firm and and set Campbell up by asking him to move her car. According to the Tampa Bay Times, Personius said she didn't tell Campbell where she worked because "you don't give your personal true information to anyone you don't know." Another Schnitt attorney, Jonathan Ellis, alleges that Personius told Campbell she worked for another law firm. Tampa Police DUI Sgt. Ray Fernandez testified that one of Bubba's attorneys, Adam Filthaut, called the police to report Campbell.




Harris Broadcast and GBS Helping Radio to Target Ads

Harris Broadcast and Geo-Broadcast Solutions are working together to provide targeted advertising based on the GBS ZoneCasting while the industry awaits FCC approval for ZoneCasting. "MaxxCasting" uses a network topology similar to the ZoneCasting architecture for targeted, over-the-air radio broadcasting, but instead focuses on simulcasting content to improve coverage which can be deployed under current regulations. "We often hear from broadcasters looking to take advantage of this network topology as our ZoneCasting petition to deliver targeted content moves through FCC approval," says Geo-Broadcast Systems CEO Peter Handy. "The FCC rules currently allow FM stations to deploy boosters to fill in signal coverage gaps, broadcasting identical content on every booster. We have discovered that adding boosters to simulcast across the typical ZoneCasting topology can help broadcasters improve coverage." Harris, we're told, has an exclusive, worldwide license to use and incorporate the GBS ZoneCasting software and hardware design into its Flexiva transmitters and Intraplex SynchroCast systems for deployment in ZoneCasting systems. Broadcasters would use these same tested and proven technologies for MaxxCasting systems. "ZoneCasting was created to bring hyper-localization to over-the-air radio, bringing new advertising opportunities to local businesses and to allow stations of any size to better compete in a challenging landscape," says Harris Broadcast VP of Transmission Systems Product Management/Strategy Richard Redmond. "But a high percentage of radio stations today would like to improve their reach. MaxxCasting allows them to fill out the signal area that they originally purchased, to the maximum of what the FCC allows through their broadcast licenses."




Radio One Back in Nasdaq Compliance

Radio One tells the SEC that the company's stock is back in compliance with Nasdaq's minimum bid price. In the filing, Radio One says it has received a letter from Nasdaq advising it that their Class D shares traded under the symbol ROIAK, had regained compliance with the minimum bid price listing requirements and were in good standing on the Nasdaq National Market. The letter received January 24 from Nasdaq says that because the Class D shares closed above the $1.00 minimum bid price for the 10 consecutive trading days ended January 23, 2013, the threat of delisting had ended.

Cheryl Park returns to "99.9 Cape Cod's Fresh Mix" WQRC-FM, this time as afternoon host. Park stepped down after seven years in mornings, two months ago. She says she's glad to be back for the later shift ... "The Stoneman" Jay D. Stone is named Assistant PD at Greenville's Classic Rock "Rock 101" WROQ-FM and Active Rock "New Rock 93.3 - The Planet" WTPT-FM. He will also continue to serve as Music Director at WROQ-FM ... Google Seeks FCC Approval for 'Experimental Radio Network'

Google is requesting FCC permission to build an "experimental radio network" - but most informed observers say it isn't as big a deal as some might think. Digital Trends notes, "While this may seem like Google’s jump into the wireless space with the likes of AT&T and Verizon, don’t get your hopes up just yet." Google has filed an FCC Form 442 "application for new or modified radio station under part 5 of FCC rules - experimental radio service (other than broadcast)." The application specifically requests permission to create an "experimental radio network" in a two-mile radius surrounding its Mountain View, California, headquarters which would operate somewhere in the 2524MHz and 2625MHz spectrum. Digital Trends writes that it would be "not only experimental in nature, but far from consumer-oriented. The spectrum being tested is inaccessible by almost all current consumer electronics, including iPhones and Android devices, meaning it will be years before you see gadgets use this." However, that report tells us that "what's special about this band of spectrum is that it's very effective with high-density locations, which makes it very efficient for rolling out wireless access in big cities, and potentially even a successor to current wireless standards." Digital Trends notes that "Google actually doesn’t own the spectrum - Clearwire does, so the future of the technology is far from being in Google's hands."

AdMall Forecast: Local Sales Managers Expect 2013 Revenue Gains

Close to 90% of local media sales managers are expecting increases in advertising revenue for 2013 compared to last year, according to the new 2013 AdMall Local Advertising Sales Forecast. Some 23% of local media sales managers expect increases in excess of 10%. Only 5.9% are projecting revenue declines, while 4.8% expect advertising sales to be flat. The report shows digital and mobile advertising are expected to be key drivers of the growth. More than 70% of account executives that sell traditional media such as radio, newspaper or television now also sell some form of digital advertising. The number of local media salespeople that sell search engine marketing, for example, is up 68.4% from last year and 28.5% from six months ago. Email marketing, mobile advertising and online video are also increasing in popularity among local media companies. "The expanding number of digital product offerings, many at lower price points than traditional advertising, means effective time management is critical for today’s media sales teams," says President/CEO of Sales Development Services C. Lee Smith. "Achieving growth from online and mobile is contingent upon a refocused go-to market strategy, more efficient sales processes and multi-dimensional training."

According to the 2013 AdMall Local Advertising Sales Forecast, nearly 70% of media sales managers believe that health care will be the hottest advertising category in 2013. The other main sectors of anticipated revenue growth in 2013 are expected to be retail, restaurants and automotive. Account executives rank competition from other local media (58.9%) and overcoming advertiser churn (50.6%) as their biggest challenges to growing sales in 2013. This reveals the difficulty of trying to bring in enough new business to compensate for revenue declines and lost accounts. These two concerns also rank among the top challenges for sales managers. "Growing competition and audience fragmentation have made it more difficult to maintain an advertiser base," says AdMall VP of Sales and Marketing Barry Shawgo. "Media outlets in some markets have already crossed the line where it's not possible to sell enough new advertising to offset advertiser churn. We see this as an alarming trend that media companies must address quickly."




Bubba-MJ Trial Delayed: Schnitt’s Attorney Arrested for DUI

The attorney representing Todd "MJ Kelly" Schnitt in the trial with Todd "Bubba the Love Sponge" Clem was arrested on DUI charges Wednesday night (Jan. 23) in Tampa. Attorney Charles Philip Campbell Jr. was taken into custody around 10pm by officers in Tampa, reports www.MyFoxTampaBay.com. According to the arrest report, police spotted Campbell violating the right of way of another vehicle, then "observed him to have red/glassy eyes with a distinct odor of an alcoholic beverage coming from his breath." The 64-year-old lawyer refused a blood-alcohol test and was arrested. He was released Thursday morning after posting $500 bond, according to jail records. Campbell is representing Schnitt against his radio rival. On Thursday morning, the judge called in attorneys and granted a delay in the trial. The jury was told testimony will resume Friday. "I'm shocked that the case was continued," Bubba's attorney, Steven Diaco, said. He told the Tampa Bay TV station, "I feel horrible for this jury that has been sequestered and pulled from their jobs, their lives, their families." Diaco said he didn't understand why Schnitt's other attorneys weren't suited to handle the case. "I'm disappointed, but it's out of my control." On his radio show, Bubba said he was "a target." "Why does everyone shoot for me? Why is everyone always gunning for me?"




Dial Global Sports Announces Super Bowl Broadcast Team

Dial Global Sports announces that its broadcast team for Super Bowl XLVII will feature Kevin Harlan, Boomer Esiason, James Lofton, Mark Malone, Jim Gray and Scott Graham. Super Bowl XLVII will air live from the Mercedes-Benz Superdome in New Orleans, February 3. The game broadcast will be heard on more than 700 stations, as well as on SiriusXM, NFL.com/Audiopass and the NFL Mobile App via Verizon Wireless. The Monday Night Football broadcast team of Kevin Harlan and Boomer Esiason will call their third Super Bowl together. Esiason will play two positions on Super Sunday -- pregame, halftime and postgame analyst for television and game analyst for radio. This is the fourth time that Esiason will pull double-duty for the Super Bowl, having previously done that for Super Bowls XXXVIII, XLI, and XLIV. Hall of Fame wide receiver James Lofton will patrol the 49ers' sidelines and former NFL quarterback Mark Malone will report from the Ravens' sidelines. Jim Gray hosts the pregame and halftime shows, as well as provides interviews and insight from athletes and celebrities in attendance. Three-time Super Bowl quarterback Tom Brady and Pro Bowl wide receiver Larry Fitzgerald will join Jim Gray as part of the pregame and the halftime coverage.

"Energy 106.9" WNRG-FM, Milwaukee, names Cousin Ed for afternoons, starting January 28. Cousin Ed, a Wisconsin native, was most recently part of the morning show on "Hot 101.5" WPOI-FM, Tampa. Formerly known as "Special Ed," he's Jeremy Schulz, to distinguish him from others using the "Cousin Ed" airname. He has also aired in Wausau, Wisconsin, as well as North Carolina and South Carolina. Says Ed, "I'm excited to be back home in Wisconsin where the flu bug might struggle to survive the bitter cold temperatures."

Talk KSEV-AM, Houston, is revising its lineup, as afternoon co-host Chris Baker exits, while station veteran Edd Hendee returns, allowing Richard "Mack" Machowicz to move from mornings to afternoons. Hendee had been mostly off the air since the February 2010 death of his son Edd K. Hendee in a Vermont skiing accident. Baker, who joined KSEV-AM last May, says he can't comment on his next move, but said that station owner, and Texas State Senator Dan Patrick is "the most gracious and accommodating guy that you could ask to work for." He adds, “Dan always wants people to better themselves. In this day and age and in this industry, it is rare to have a manager who will always root for peoples’ success." Baker has aired in afternoons, co-hosting a show with Patrick. Machowicz will take over that role moving from his morning "Mack Show." The station describes itself as "Houston’s independent voice for conservative opinions."

Clear Channel Boston appoints Matt Tilden as Local Sales Manager of Electronic Dance Music "Evolution 101.7" WEDX-FM. Tilden joined Clear Channel Boston in 2005 as an Account Executive, after working as an AE at crosstown CBS Radio. "Matt has been a huge asset for us at Kiss 108 and has many great relationships within the market," says Clear Channel market VP of Sales Alan Chartrand. "He is a natural born leader with incredible passion and we are thrilled to have him lead the sales efforts for the innovative, one of a kind radio station, Evolution 101.7." Tilden adds, "I've seen firsthand the impact of EDM in Boston and I am confident that it will serve as a valuable asset for our clients to reach this passionate group of listeners."

Actor, author, "Dancing with the Stars" champion, motivational speaker and retired U.S. Army soldier, J.R. Martinez, will add talk radio host, taking a Sunday evening shift (6-8pm) on KFI-AM, Los Angeles. He takes over from David Cruz, who will step down from Sunday nights to focus on his new expanded four hour program on co-owned KTLK-AM. "He's so inspirational and dynamic. He filled in for Bill Carroll during the holidays and I just had to have him join our line up," says KFI-AM Program Director Robin Bertolucci. "I'm thrilled he jumped at the opportunity and I'm excited to see what he will do with his own show."

Kathy Merritt is the new VP of Content Strategy and Development for Public Radio International. Merritt most recently was Senior Director, Program Investments/Radio at the Corporation For Public Broadcasting. In her new role, Merritt will report to PRI Chief Content Officer Melinda Ward. Public Radio International, based in Minnesota, produces and distributes a number of programs for public radio stations. PRI, considered a major public media content creator, also distributes programs from many sources, competing with NPR and American Public Media.

Cumulus Media CFO J.P. Hannan denies that Cumulus is seeking to acquire CBS Radio. We, and others, recently reported that CBS Corporation might be looking to sell off its radio division, and that Cumulus Media could be the buyer. That speculation was fueled by a New York Post report that suggested it's under serious consideration, and that Cumulus Media wants to be the buyer. However, at the Noble Financial conference in New York City, Hannan said Cumulus is not planning to "be a huge buyer of assets" over the next couple of years. As we noted in our previous report, CBS also denied it had any possible plans to spin off its radio division.

Veteran Milwaukee radio personality Jack Lee is retiring after a 58-year career at the age of 76. Lee started in the market as an on-air host at Top 40 WOKY-AM in 1965, and was there through 1970. Now he's retiring from Milwaukee Radio Group, where he's most recently been the Director of Integrated Media, with plans to return to Tennessee. That's where he started in radio, at a station built and run by his father.

Former AC "Lite FM" KVIL-FM, Dallas, morning host Ron Chapman has been released from the hospital, a month after suffering a stroke. The Dallas Hall of Fame broadcaster is said to have made a lot of progress, but is still experiencing some effects of the stroke. "My left side doesn't do what my right side does," says Chapman, who tells the Dallas News that he will "likely be hiding out at home for a few months."
