Nielsen to Divest Arbitron 'Project Blueprint' Interest

As part of the agreement for FTC approval of its $1.3 billion acquisition of Arbitron, Nielsen will divest a key component of its PPM technology that's been part of the "Project Blueprint" cross-platform audience measurement system being developed by Arbitron and comScore for ESPN. Yesterday (Sept. 23), Nielsen offered investors an "Arbitron Acquision Update" during a conference call. Nielsen will not effectively enter into a joint venture with comScore on that project, as previously planned by Arbitron, but will license the technology to comScore for a period up to eight years, and comScore would use it to develop its own service. The agreement with the FTC asks Nielsen to find a third party Licensee acceptable to the FTC (comScore, if chosen, has already been approved) to sign a "Remedial Agreement" for the continued provision of Arbitron services involved in the Project Blueprint cross-platform project developed by Arbitron, ESPN and comScore last year, and delivering a cross-platform view of ESPN content. Former Arbitron employee Jay Guyther is appointed as Monitor of this condition, overseeing Nielsen’s compliance. The Arbitron services in question must be made available for the project for a period of eight years. If Nielsen fails to find a Licensee within three months, the FTC may appoint a Trustee to find one sometime in the following nine months. The services Arbitron must continue to provide are radio and TV PPM data, and data from the Calibration Panel, a subset of 2,000 PPM panelists who have downloaded comScore’s online meter and provide data on viewing behavior across radio, TV and online. Nielsen must also transfer to the Licensee Arbitron’s interest in the Link Meter technology developed for Project Blueprint, linking PPM and calibration panel measurements. Nielsen may charge the Licensee its Direct Cost for providing the services. The future employment of seven Arbitron employees who were involved in "Project Blueprint" is also covered by the terms.

During the Monday conference call, Nielsen CEO David Calhoun said Nielsen is "obliged" to sustain the Project Blueprint relationship, even if it decides down the road that it no longer wants to support the Portable People Meter technology for its own reasons. However, Calhoun said Nielsen is eager to begin integrating Arbitron's PPM technology into its measurement of out-of-home media, but said it would be up to Nielsen's clients to determine whether it gets included in TV advertising "currency." A bigger impact of the out-of-home measurement, Calhoun suggested, might be in retooling so-called "marketing mix models" that many marketers use to help determine how much of their marketing budgets they allocate to various media.

Nielsen also confirmed Monday that it will retire the Arbitron name after the September 30 closing for a Nielsen-related name to be announced. Nielsen CFO David West also said there will be some restructuring associated with the merger of the two ratings companies, which Calhoun and West told investors would be part of an "expected annualized savings of at least $20 million." Nielsen's presentation told investors that with regulatory approval completed and integration plans underway, there will be "no change in strategic rationale or financial benefits of the acquisition or the competitive landscape; No current Nielsen assets are subject to the agreement and Closing expected for Nielsen/Arbitron acquisition on September 30, 2013."



LM Communications Responds to Arbitron Lawsuit,
Defends Itself and Attacks Arbitron for 'Misconduct'

It looks like Nielsen will inherit this one! LM Communications has filed a response to Arbitron's lawsuit against them for using its ratings data. According to LM, Arbitron "has known, or should have known, that it does not, and cannot, own any copyright rights in any data, information, rankings, or other factual listings, and that it cannot prevent third parties including radio stations from receiving in using this unprotectable data." The filing claims that Arbitron has engaged "in a calculated campaign to maintain its monopolistic stranglehold on the radio ratings market ... through threats and filing of multiple lawsuits and by improperly manipulating its data to punish nonsubscribers." Beyond defending itself, LM also launches an attack on Arbitron. "Plaintiff has attempted to impermissively extend the scope of any copyright rights it may have, in a calculated campaign to maintain its monopolistic stranglehold on the radio ratings market. Plaintiff has done so through threats and filing of multiple lawsuits and by improperly manipulating its data to punish nonsubscribers. This improper manipulation includes, among other things, threatening to gerrymander radio station markets to improperly force subscription to Arbitron's services, and outright exclusion from the data rankings of non-subscriber stations is if they do not exist at all. Arbitron has announced plans to implement additional discriminatory practices in the future including combining simulcast data for only subscribing stations to give them an advantage over nonsubscribers. In doing so, plaintiff has made a mockery of the very 'facts' and 'data' it seeks to protect. Plaintiff's misconduct in engaging in acts of copyright misuse has the effect of rendering Plaintiff's copyrights, to the extent valid at all, unenforceable." Last month we reported that Arbitron had filed another lawsuit against a broadcaster over alleged unauthorized use of its ratings and audience data. According to the suit, LM Communications used its ratings information for the Charleston, SC, market, although the company only subscribes to Arbitron for the Lexington, Kentucky, market. In its complaint filed in U.S. District Court in Kentucky, Arbitron claimed that LM copied, distributed and used its copyrighted data for Charleston between the spring of 2009 and May of this year. U.S. District Judge Karen Caldwell has now issued an order that the parties meet within 21 days of September 18 to try to negotiate a settlement, and file a report within 10 days after the meeting.



Mark Kassof: Good News and Bad News for Radio:
More Than 50% Agree 'Radio Isn't as Good as It Used to Be'

"This year's ListenerThink P1 research explores the role of radio in listeners' lives from many angles -- what they think of it, its importance and the benefits of listening," writes Mark Kassof today (Sept. 24). "The results are mostly positive, but there's some negative too. Today, the bad news -- based on 989 online interviews with 18-64 U.S. radio listeners, conducted September 12-15, more than half agree Radio isn't as good as it used to be." According to a new "ListenerThink" from Mark Kassof and Company, 19% "agree strongly" and "34% agree slightly" for a total of 53% that agree radio "isn't as good as it used to be" -- while only 41% disagree (13% strongly, 28% slightly). Says Kassof, "From a demographic perspective, 18-34′s are most negative -- 61% agree, while only 31% disagree (and just 9% disagree strongly). What's interesting is the oldest of them were only teens when The Telecommunication Act of 1996 became law ... law that enabled 'mega groups' that many blame for the decline of radio. Men are, overall, more negative than women, and 18-34 men the most negative -- 67% of them agree that radio is not as good as it used to be, while only 28% disagree. In contrast, 45-54′s — both women and men – are the most supportive of radio on this question, 45% agree, 50% disagree. But that's far from an enthusiastic defense of the radio's direction!" Kassof concludes, "Fortunately, that's the extent of the bad news in this year's P1 research." And he promises, the first of the good news will be released Wednesday (Sept. 25).

CBS Radio and WestwoodOne partner to launch "Fierro" -- a 24/7 Regional Mexican music format. Content for Fierro originates from "La Grande 107.5 FM" KMVK-FM, Dallas, including both the music and the station's air personalities. We're told that Fierro is designed for the "Spanish-language dominant Male 25-44," and features Regional Mexican artists including Intocable, Duelo and Presado, as well as newcomers such as Luis Coronel. "Fierro's strength lies in teaming the hottest Regional Mexican hits with some of the very best radio talent in any format," says CBS Radio VP of Spanish Programming Jimmy Gonzalez, who also is Program Director of KMVK-FM. "It's a winning combination which will resonate with this target audience." WestwoodOne is the network's exclusive syndicator and sales partner handling affiliate agreements and ad sales. "The launch of Fierro with our partners at CBS Radio is another demonstration of our commitment to the Spanish-language radio space," says WestwoodOne President of Programming Kirk Stirland. WestwoodOne is the former Dial Global and is currently being acquired by Cumulus Media pending regulatory approval.

Wagner will report to Glynn Alan, Regional Market Manager for Tucson, Las Vegas and El Paso, who will now be based out of Las Vegas. He had been overseeing the Tucson cluster. "I am excited to return to Tucson and work with the extremely talented staff and incredible brands to support our clients, sponsors, listeners and the community," says Wagner. Over 11 Million Users Tuned to iTunes Radio Since Launch,
First Weekend iPhone Sales Set New Record

Apple says that over 11 million unique listeners have already tuned in to its new iTunes Radio service in less than a week, since its launch as part of iOS 7 last Wednesday. The most listened to song has been Drake's "Hold On, We're Going Home." The announcement came in a news release reporting record sales for its new iPhone 5s and 5c models, which were released Friday. Apple says it had sold "a record-breaking nine million new iPhone 5s and iPhone 5c models, just three days after the launch of the new iPhones on September 20. In addition, more than 200 million iOS devices are now running the completely redesigned iOS 7, making it the fastest software upgrade in history. Both iPhone 5s and iPhone 5c are available in the U.S., Australia, Canada, China, France, Germany, Hong Kong, Japan, Puerto Rico, Singapore and the UK. Demand for iPhone 5s has exceeded the initial supply, and many online orders are scheduled to be shipped in the coming weeks." Says Apple CEO Tim Cook, "This is our best iPhone launch yet - more than nine million new iPhones sold - a new record for first weekend sales. The demand for the new iPhones has been incredible, and while we've sold out of our initial supply of iPhone 5s, stores continue to receive new iPhone shipments regularly. We appreciate everyone's patience and are working hard to build enough new iPhones for everyone." The initial record sales of the new iPhones nearly doubled their previous launch weekend record. Apple's iTunes Radio -- the new all-you-can-listen-to streaming music service -- is built in to the iPhone, iPod touch, iPad, Apple TV, and iTunes on the Mac, and it's included with the release of iOS 7.



Jacobs Media to Present DASH Conference in Detroit

Lawmakers Want Navy Yard Faulty First Responder Radios Probe

Reps. Henry Waxman (D-CA) and Anna Eshoo (D-CA) are asking the FCC and the National Telecommunications and Information Administration to help determine whether first-responder radios malfunctioned during the shooting rampage this past week at the Navy Yard in Washington. "It is imperative that we understand what happened to these communications systems and why," the lawmakers wrote in a letter to the heads of both agencies, urging them to work with other federal and local officials to investigate the problems. They also urged the officials to ensure that FirstNet, a planned nationwide wireless network for first responders, avoids similar communications breakdowns, reports The Hill. "This horrific incident serves as a further reminder just how critical it is for FirstNet to succeed in its mission," the two House lawmakers wrote. It has been reported that some federal firefighters and police officers were unable to communicate with their radios during the Navy Yard attack. Some equipment stopped working as officers ventured into buildings, and at least one officer was forced to rely on his cellphone, according to union officials for first responders.

Reuters: 'Univision in Talks with Banks About 2014 IPO'

Univision is reportedly considering an IPO (initial public offering). Reuters reports that "in recent weeks" Univision Communications has "held discussions with banks" about an IPO, "according to three people familiar with the matter, as strong stock markets encourage private equity owners to seek exits for their portfolio companies." Univision was taken private by a group of buyout firms for $12.3 billion in 2007. The investors included Madison Dearborn Partners, Providence Equity Partners, TPG Capital and Thomas H. Lee Partners. "The company is leaning toward an IPO, which may come in the second half of 2014, as the board continues to evaluate the company's strategic direction, one of the people said, adding that Univision has not yet made a formal decision to proceed with the offering," says the Reuters report. "All the people asked not to be identified because the discussions are confidential. Univision, Madison Dearborn, TPG, Providence and THL declined to comment." Reuters says that a "surge in the equity markets this year has encouraged large private equity-backed companies to pursue IPOs." In addition to Univision Radio, Univision Communications owns "a highly rated Spanish language broadcast television network that sometimes beats English language broadcasters such as NBC in the primetime ratings race. It also owns another broadcast channel called UniMas, as well as several cable networks."



CBS Radio Partners with Brooklyn Nets and Barclays Center

Entercom will launch a revamped format with the new branding "3WL 1350" at WWWL-AM, New Orleans, October 14. Currently Sports Talk as "ESPN 1350," the station will move to a mix of local talk and programming from NBC Sports Radio, becoming a hybrid sports and local talk station, featuring "Sports, Food and Fun." The company makes the announcement in a news release for "the launch of a new station, 3WL 1350. Clear Channel is hailing the success of the two-day iHeartRadio Music Festival in Las Vegas, which "came to a close Saturday night following a weekend of incredible performances by the biggest names in music." Says Clear Channel, "The Festival, which celebrated the success of the iHeartRadio all-in-one digital audio service, included performances by over 40 artists, both on the main stage at the MGM Grand Garden Arena in Las Vegas on September 20 and 21 and at the all-new iHeartRadio Music Festival Village on Saturday afternoon." Ryan Seacrest kicked off the Festival Friday night at MGM Grand with performances by artists Robin Thicke, fun., Keith Urban, Muse, Tiesto, J. Cole, Elton John, Benny Benassi, Chris Brown, Katy Perry and Queen + Adam Lambert. Paul McCartney opened the second night, and reset the already high bar with an eight-song set that included a medley of songs combining work from his upcoming album New with some of his most classic hits. McCartney used the Festival stage to debut three new songs. The action continued throughout the evening with back-to-back top-notch performances including Zedd, Maroon 5, Tim McGraw, Miley Cyrus, Thirty Seconds to Mars, Bruno Mars, Phoenix, Miguel, Ke$ha featuring Joan Jett, Drake and Justin Timberlake.

"The iHeartRadio Music Festival weekend was again notable for the unparalleled number and diversity of incredible performances, thrilling collaborations and special guests appearances, including Diddy, who helped kick off the Festival by introducing Robin Thicke to the stage for the opening performance of 'Blurred Lines' on Friday night, and Britney Spears, who introduced Miley Cyrus on Saturday. BMI Announces Highest Royalty Distributions in Company’s History

Broadcast Music Incorporated (BMI) today reports record revenues and royalty distributions for its fiscal 2013 year, which ended June 30. Revenues increased by $45 million, a five percent gain over the prior fiscal year, exceeding $944 million. The company also says it brought in a "historic new high in royalty distribution" -- with $814 million for BMI-affiliated songwriters, composers and music publishers. Royalty distributions increased by $64 million or nine percent compared to the previous year. "This represents the largest fiscal year revenue posted and royalties distributed in BMI's 74 year history and tops a five-year period in which BMI generated more than $4.5 billion in revenues and paid out royalties of $4 billion." Says BMI President Del Bryant, "The success we are reporting today has been achieved in a very transitional period for BMI and the music and entertainment business. We are alert to the challenges that the restructuring of the industry presents, but we also see unprecedented opportunity. BMI’s dynamic and constantly evolving repertoire is able to reach the public across a myriad of platforms in which music is the core offering, or an essential part of the creative product. As this year’s results demonstrate, we have continued to capture the value that music contributes, and deliver it to our writers, composers and publishers." New media and digital revenue continued its year-over-year pattern of growth, reaching new record revenues exceeding $57 million, an increase of 65 percent over the previous fiscal year. This achievement was driven in large part by agreements with Netflix, Hulu and other digital entertainment outlets. Licensing revenues from bars, restaurants and other commercial establishments saw a seven percent increase over the prior year to a new benchmark high of $116 million. In addition, international revenues contributed $297 million, more than 30 percent of BMI’s total for the year. "Music is more pervasive in our lifestyle and across more platforms than ever before," says Bryant. "We are alert to the challenges. Michael Savage Returns to Boston's WRKO-AM

Entercom's WRKO-AM -- "Boston's Talk Station" -- tells us that Conservative Talk radio/multimedia host, author and political commentator Michael Savage has returned to the station after a one-year absence. "The Savage Nation" -- now syndicated by Cumulus Media Networks -- airs weeknights 10 pm-1 am. "The people in Boston are realists, we understand each other," says Savage. "I appreciate the city." Heard by millions of listeners a week across the United States, Savage is also the author of 25 books, including four New York Times best-sellers. WRKO-AM had previously aired "The Savage Nation" until he left his former longtime syndication company, Talk Radio Network, after winning a nearly two-year legal battle against the company. WRKO-AM had featured Savage in its evening schedule from November 2002 until September 2012, when the station filled the gap with Cumulus' national talker Mark Levin.



Stephanie Callihan Appointed Clear Channel Wichita Market Manager

Callihan returns to Clear Channel from the former ABC/Citadel Dallas, where she was Director of Sales for 13 years until September 2011. NAMB Elects Glenn Serafin President

The National Association of Media Brokers (NAMB), representing buyers and sellers of radio and television stations and related businesses, elected a new slate of officers at its semi-annual meeting during last week's NAB/RAB Radio Show in Orlando. Elected to serve a two-year term as President of NAMB is Glenn Serafin, Director of Tampa Florida-based Serafin Brothers. Elected Vice President was Mark Jorgenson, the founding partner of Jorgenson Broadcast Brokerage. The Secretary of NAMB is Roger Rafson, the owner of CMS Station Brokerage, who, at 55, is celebrating 44 years in broadcasting. Greg Guy is the new Treasurer of the NAMB. A Managing Partner of Patrick Communications, his background includes stints at the NAB and the FCC. Two NAMB members -- Ed Henson of Henson Media and Eddie Esserman of Media Services Group -- also are members of the NAB Radio Board of Directors. NAMB member and past President Larry Patrick of Patrick Communications is Chairman of the NAB Political Action Committee (NABPAC). All three are station owners.



ESPN Joins IPG Mediabrands’ Magna Consortium

ESPN's Customer Marketing and Sales announces that ESPN will join the Magna Consortium, a group dedicated to using data and technology to unlock the true power of all media. ESPN will contribute to the Consortium's efforts to test new standards to drive efficiency and automation across all media transactions. "Given the dynamic nature of live sports programming, these new models have the potential to increase our efficiency and campaign effectiveness across all platforms," says Eric Johnson, EVP of Multimedia Sales at ESPN. "Ultimately this will allow our teams to spend less time on nominal tasks and more time on creativity and activation, thereby further enhancing our premium sales proposition and client service." Nielsen Announces FTC Approval of Arbitron Purchase

Late Friday afternoon we reported that the FTC had approved Nielsen's acquisition of Arbitron. We now have the full news release issued by Nielsen, and are offering it as provided for our readers:

"Nielsen Holdings N.V. (NYSE: NLSN), a leading global provider of information and insights into what consumers watch and buy, today announced that it has reached an agreement with the Federal Trade Commission (FTC) to gain clearance for its proposed acquisition of Arbitron (NYSE: ARB), which is now, subject to customary closing conditions, expected to close on Sept. 30, 2013. The FTC has issued a Decision and Order dated Sept. 20, 2013 that embodies the agreement.

As previously disclosed, Nielsen entered into an agreement on Dec. 17, 2012 to acquire all of the outstanding common stock of Arbitron for $48 per share, or a total of $1.3 billion purchase price, funded by cash on hand and minor debt financing. Adding Arbitron to Nielsen will enable broader measurement of what consumers are watching and listening to around the world and deeper measurement of multicultural audiences in the U.S. The combined company will expand advertising effectiveness for radio clients and be better able to solve for unmeasured areas of media consumption, such as streaming audio and out-of-home. Nielsen expects $0.26 of accretion to adjusted net income per share in the first full year of operations, and $0.32 of accretion to adjusted net income per share after the second year, reflecting an incremental $0.06 in year two.

'We are pleased to have the regulatory process behind us and are excited to be closing the Arbitron acquisition,' said David Calhoun, CEO, Nielsen. “We are looking forward to providing all of the benefits of the combined company to our new clients in the radio industry and their advertisers, driving incremental value for them as well as our shareholders.'

Nielsen's agreement with the FTC is intended to preserve the competitive landscape in place before its announced intent to acquire Arbitron. It does not affect the strategic rationale of the acquisition or the anticipated benefits to Nielsen from the transaction. No Nielsen assets are affected by the FTC’s order. The FTC’s order effectively enables the continuation of a cross-platform project measuring TV, radio, PC, mobile and tablet engagement, which was announced by Arbitron in concert with ESPN and comScore, Inc. in September 2012. In the event that an FTC-approved third party elects to agree to licensing terms and other requirements, Nielsen would make available for license Arbitron PPM and related data as well as software and technology currently being used in the ESPN project for the sole purpose of cross-platform measurement[1] for up to eight years.

'We are very pleased with the FTC action, which meets our original expectations at the time of the merger agreement. This is a highly acceptable outcome for us as it doesn’t change the market landscape and allows us to proceed with the deal,' continued Calhoun. 'The area of cross-platform measurement is still in its early stages and its value is yet to be determined by the market. This morning we reported that it could come today, and indeed it does -- as Nielsen Holdings tells us that it has reached an agreement with the FTC to obtain a green light for its proposed acquisition of Arbitron. The acquisition is now subject to customary closing conditions and expected to close September 30. Last December, Nielsen agreed to acquire all of the outstanding common stock of Arbitron for $48 per share or a total of $1.3 billion purchase price, funded by cash on hand and minor debt financing. Nielsen's $1.3 billion acquisition of Arbitron could be approved by the FTC as soon as today. Sources tell The Wall Street Journal that government approval could happen any day now, but "with conditions including one to ensure Arbitron continues a measurement initiative with Nielsen rival comScore Inc." WSJ says that Nielsen will add data for Mobile TV viewing, as it makes "some significant moves" after having "been slow to adapt to new technologies and expand its reach to other media services," according to its industry critics. "Next week Nielsen will announce plans to augment its TV ratings data with information on viewing on tablets and smartphones, meeting a major demand of media companies that say they aren't getting credit in the current system for viewing on mobile devices. The change won't take effect until next fall's TV season, however." Of course with the acquistion of Arbitron, Nielsen will have the radio ratings company's PPM (Portable People Meter) technology at its disposal, as one new technology for Nielsen. That, notes WSJ, is "technology to advance Nielsen's TV measurement capabilities outside homes." The Wall Street Journal also is reporting that Nielsen "plans to roll out a planned Twitter-related ratings service" on September 30, that "will measure the audience that sees tweets about TV shows to help gauge their popularity. Early findings showed that for every one tweet about a TV show, roughly 50 people see it, the company says."

Meanwhile, the Tom Taylor NOW newsletter says radio should prepare to say goodbye to the Arbitron name. "It appears to be a 'when, not if' question, based on what NOW is hearing around the Radio Show," writes veteran radio/media news reporter/analyst Tom Taylor. "Nielsen has apparently concluded that its brand name is better known than Arbitron. Why does it matter? When a research company contacts a potential survey participant, having a recognizable name can help it gain trust." Taylor cites an unnamed "observer" as saying, "Nielsen's thinking that 'Nielsen' is better known than 'Arbitron'." According to Taylor's report, "A change – or at least the announcement of one – could come soon after the deal closes."

Wells Fargo Analyst Marcy Ryvicker 'Really Likes' NextRadio App

Wells Fargo analyst Marcy Ryvicker says she "really likes NextRadio" -- the smartphone app that puts FM radio on mobile devices. In her client letter today, Ryvicker writes, "Local advertising is trending 'a little bit better.' We just returned from a three-day stint of broadcast conferences and one-off regulatory meetings, where we got an update on local ad trends as well as what might (or what might not) be happening in D.C. Bottom Line: We came away incrementally positive on the broadcasters, as most of our contacts suggested that the local ad environment is trending a bit better than expected -- driven by auto, wireless and healthcare." NextRadio Ryvicker adds, "We really like NextRadio. As a whole, radio industry revenue remains relatively flat (July was 'awful,' August 'okay' and September 'en fuego'), although NY and LA are still the big outperformers. We spent a lot of time on NextRadio and were pleasantly surprised with how well this app has been received. At this point, we don’t know why the entire radio industry wouldn’t jump on board -- with little to no downside, it feels like this really inexpensive option could be worth a lot of money down the line."



Las Vegas' Country KWNR-FM Now Full of 'Bull'

Clear Channel Country KWNR-FM, Las Vegas, rebrands as "95.5 The Bull" and launches three weeks of commercial-free specialty programming, with 8,000 of today's top Country songs in a row. Artists include Eric Church, Blake Shelton, Carrie Underwood, Jason Aldean and Luke Bryan. Program Director Jojo Turnbeaugh remains in place and will continue to host afternoons 3-7pm, while Premiere-syndicated "The Bobby Bones Show" continues in mornings. "95.5 KWNR The Bull is today's hottest Country format showcasing emerging artists and music," says Regional Market Manager Glynn Alan. "It's exciting to take 95.5 KWNR into the fast lane with The Bull, which will definitely be a winning format for our listeners and partners." Regional Programming Manager Chris Pickett adds, "Finally we have a radio station that embodies the lifestyle and musical tastes of Southern Nevada." New Orleans TV News Anchor Angela Hill Joins WWL Radio

WWL-AM-FM, New Orleans, tells us that "iconic news anchor and beloved personality Angela Hill will join the WWL Radio lineup effective Monday, September 30th." Hill will take over the 1-4pm slot. "It doesn't get any bigger than this," says Chris Claus, VP and General Manager of Entercom New Orleans. "Not only is Angela a household name, she's one of the most respected, popular and beloved personalities in New Orleans and the Gulf South." Hill, who retired from WWL-TV earlier this year, tells us, "I am sure people are asking, 'what happened to retirement?' I always said I was looking for the next chapter of my life. This is a natural fit, it's in the city I love and talking with the people I love. I'll have the opportunity to get to know my community better, and they’ll get to know me better. Eight More Members of Congress Add LRFA Support

Seven Members of the House of Representatives and one Senator have signed on as co-sponsors of the resolution that opposes "any new performance fee, tax, royalty, or other charge" on local broadcast radio stations. Reporting the additional support, the NAB tellsd us, "The Local Radio Freedom Act is now currently co-sponsored by 166 Members of the House and 12 Senators." Says NAB EVP of Communications Dennis Wharton, "NAB is delighted by the growing bipartisan support for hometown radio stations on an issue of critical importance to the American economy. Going forward, we're hopeful that more members of Congress will sign this resolution in support of local radio." The members of the bipartisan group adding their support to the Local Radio Freedom Act are Reps. Steve Daines (MT-AL), Sean Duffy (WI-7), Tim Griffin (AR-2), Ann Kuster (NH-2), Mike McIntyre (NC-7), Martha Roby (AL-2) and Tim Walz (MN-1). Sen. Tom Udall (D-NM) is the latest Senator to sign on as a co-sponsor of a companion resolution in the Senate. Reps. Michael Conaway (R-TX) and Gene Green (D-TX) introduced the Local Radio Freedom Act (H. Con. Res. 16) in the House of Representatives on February 15 along with 71 additional co-sponsors. An identical resolution (S. Con. Res. 6) was introduced in the Senate on March 6 by Sens. John Barrasso (R-WY) and Heidi Heitkamp (D-ND). "Congress should not impose any new performance fee, tax, royalty, or other charge relating to the public performance of sound recordings on a local radio station for broadcasting sound recordings over-the-air, or on any business for such public performance of sound recordings," reads the Local Radio Freedom Act. The additional support comes after our Wednesday report that Congress is again being asked to consider performance royalty fees to be paid by over-the-air radio stations to go to artists and recorded music labels, by U.S. Rep. Mel Watt (D-NC).

American Urban Radio Networks (AURN) hosted their 11th Annual Urban Knight Awards at the 2013 NAB/RAB Radio Show in Orlando. Among the winners were Perry Publishing and Broadcasting Company Chairman and CEO of Russell Perry, who received the Sydney L. Small Lifetime Achievement Urban Bishop Award; Glory Communications President and CEO Alex Snipe, who was inducted into the Urban Knight Hall of Fame; KJLH-FM, Los Angeles, VP and General Manager Karen Slade who received the Urban Knight Award; and New York-based SupeRadio President and COO Jack Bryant, who received the Urban Knight Award. AURN, the only African American-owned radio network company in the U.S., is the largest network reaching Urban America with nearly 20 million listeners each week.



NABEF Announces Radio Personality Project Winner Mamie Shepherd

NAB President and CEO Gordon Smith recognized radio host and programmer Mamie Shepherd as the winner of the NAB Education Foundation's (NABEF) inaugural Radio Personality Project. The announcement was made at the NAB/RAB Radio Show in Orlando. The Radio Personality Project is an initiative of NABEF to identify a creative and talented individual who has yet to be discovered by the Radio industry. "Shepherd's entry stood out among a variety of high quality entries. A graduate of the University of Georgia's Grady College of Journalism and Mass Communication, she currently coordinates programming and serves as on-air talent at the Levine Children's Hospital's Seacrest Studios broadcast media center in Charlotte, NC." At the Radio Show, Shepherd conducted interviews with celebrities who were participating in the event, including Ann Compton, Carson Daly and Big Sean. She also co-hosted a shift at Orlando's CBS Radio's "102 Jamz" WJHM-FM, Daytona Beach, Florida.



AllThingsD Founders, Wall Street Journal Are Divorcing

Dow Jones confirms reports that the popular tech news site All Things Digital and The Wall Street Journal are divorcing. “For years, Dow Jones/The Wall Street Journal has enjoyed working with Walt Mossberg and Kara Swisher to bring the best of tech coverage to readers around the world under the All Things Digital brand, however, after discussions, both parties have decided not to renew the agreement when the contract expires at the end of this year," says Gerard Baker, Editor in Chief of Dow Jones and Managing Editor of the Journal. The Journal, however, will retain the AllThingsD brand. Baker adds that the Journal intends to double down on tech coverage by expanding its conference business and bringing on about 20 new editorial staffers. "This new initiative will be an integral part of The Wall Street Journal and will be rooted in the Journal's reputation for excellent, fair, objective, reliable and stimulating journalism," says Baker. The split means Mossberg's long-running column at the Journal will also end, according to Baker. "I want to offer heartfelt thanks for more than twenty years of Personal Technology columns as well as his very fine reporting on national and international affairs in the years before he turned his attention to technology coverage." Swisher and Mossberg have reportedly talked with NBCUniversal about a potential investment.



FCC to Hold Another LPFM Webinar in October

The FCC will hold its second webinar to answer questions about Low Power FM, and the process to apply for a new LPFM license during the October 15-29 open-filing window. The webinar, says the Commission, is set for October 3, from 1-2:30pm ET. The session will be a Q&A for potential applicants to ask Media Bureau staff questions. The webinar will be streamed live over the Internet at www.fcc.gov/live. Presentations will be available both during and after the sessions at www.fcc.gov/event and will be archived. Entercom Rock KISW-FM, Seattle, unveils a vodka campaign to benefit the Washington State Council of Fire Fighters Fund. KISW-FM says it is partnering with Mischief Distillery in Freemont, Washington, to present "Worker's No. 9 Vodka, made for the workingman" -- with a portion of the net proceeds to benefit the WSCFF Benevolent Fund. That fund assists firefighters and their families and also gives money to many organizations that assist residents of Washington State. KISW-FM Program Director Dave Richards tells us, "This new vodka starts at the heart of the Pacific Northwest's working man. A vodka created in the spirit of a true, honest day's work, and we're proud to support the brave Washington State Fire Fighters, who epitomize hard work." We're told that "Worker's No. 9" starts with two simple ingredients -- fresh, stone-ground grain from local fields and pure Mt. Rainier artesian water. These elements embody the hard working character at the heart of the vodka, as 6th generation local farmers grow and harvest the grain that Mischief Distillery uses in its spirits. Marconi finalists were selected by a task force of broadcasters, and the winners were voted on by the NAB Marconi Radio Awards Selection Academy. The votes were tabulated by an independent firm. The NAB Marconi Radio Awards Dinner & Show was hosted by "Shotgun Tom" Kelly of CBS Radio's KRTH-FM in Los Angeles. The show also featured a performance by Grammy Award-Winning band The Mavericks from Big Machine Label Group.



'Radio and the Connected Car' Findings Released:
140 Million Connected Cars to Be on the Road Globally by 2017

At the NAB/RAB Radio Show in Orlando today, Arbitron, Strategy Analytics and Jacobs Media presented the findings of "Radio and the Connected Car" -- an in depth look at the current state of in-car entertainment, where it’s headed and what actions radio broadcasters should take to maintain their station’s relevance in the car. According to Strategy Analytics, the connected car industry is growing. They project that by 2017 there will be 140 million connected cars on the road globally. While radio remains a strong connected car component, the study finds that the industry must adapt its strategy now to maintain that relevance in the future. Utilizing a series of videos showing automotive executives, experts in the connected car industry and consumers interacting with in-car infotainment technology, Jacobs Media concluded that there are still improvements needed in the integration and user interface of the digital dashboard. For now, radio maintains a strong presence in the automotive ecosystem. But it can't take its future status for granted.

arbitron-strategy-jacobs "Radio and the Connected Car" found that that although there’s some improvements needed with the new in-car technology, radio broadcasters need to have a strategy to remain competitive with the new in-car technology. By investigating where auto entertainment has been, where it’s going, and what has and hasn’t worked, "Radio and the Connected Car" has the following suggestions to keep radio the "King of In-car Media":
* Develop your mobile strategy with the in-car experience in mind. For many car makers their connected vehicles use smartphones to link consumers with their audio entertainment.
* Align your station’s streaming experience so that’s on equal footing with competitive streams and channels.
* Engage with the connected car technology which is rapidly changing . While radio remains strong it needs to be proactive by planning and acting now to take advantage of the digital dashboard.
* Drive a connected car. Whether you buy, lease, rent or test drive a connected car, it’s important to understand how your audience will be viewing the many in-car options that will be available to them.
* Partner with a local car dealership. Getting closer with local car dealerships will help radio focus on better understanding their needs and potentially uncover mutually beneficial opportunities.
* Attend a connected car conference. Listen and speak directly to automotive leaders about both their industry and the radio industry.
* Rethink HD Radio. Most auto manufacturers believe HD Radio is a conduit to a better consumer infotainment experience in the car.
* Form a radio in-car consortium. A radio industry consortium can provide a collective support network while protecting radio’s in-car franchise and build relationships with auto manufacturers and tier 1 electronics makers.



FCC Acting Chair Clyburn Offers Revitalization Plan for AM Radio

Speaking at the NAB/RAB Radio Show in Orlando, acting FCC Chair Mignon Clyburn circulated a Notice of Proposed Rulemaking that she says "will represent the next major step in the Commission's review of AM service." Clyburn was the keynoter at Wednesday’s opening ceremonies. She unveiled a six-point plan to help AM broadcasters. Although most were technical in nature, the first point was especially welcomed. Clyburn said the FCC would be expanding the inventory of FM translators. By the end of this year, the FCC's Audio division will be increasing the number of authorized FM translators by 28 percent. "I am happy to confirm that this morning I circulated the Notice of Proposed Rulemaking, which will represent the next major step in the Commission's review of AM service." The Notice of Proposed Rulemaking means the plan can be examined and discussed by others -- including the FCC Commissioners -- without waiting for a scheduled meeting. The notice also means more immediate action to help AM broadcasters. The proposal includes opening a one-time FM translator filing window limited to current AM licensees and permittees. They alone would be allowed to apply for new translators to augment their service areas.

Clyburn noted that "the sustainability of the AM broadcast service has been threatened by the migration of AM listeners to newer, higher-fidelity, media services." She went on to say, "The number of stations is decreasing; AM listenership is dwindling; and young people just are not tuning in. Many stations are unable to broadcast at night or must reduce their power due to the nighttime propagation characteristics of AM signals. Reinforced buildings and structures with steel frames or aluminum siding can block AM signals, leading to poor AM reception in many urban areas. And AM radio is particularly sensitive to interference from electronic devices of all types, including TV sets, vehicle engines, fluorescent lighting, computers, and power lines. But the FCC has taken discrete steps to ease regulatory burdens on AM broadcasters. We're simplifying the licensing procedures and technical requirements -- including allowing 'moment-method' modeling -- which can save licensees over $100,000. We've been expanding the inventory of translator stations. By the end of 2013, the FCC's Audio division will increase the number of authorized FM translators from 5,700 to about 7,300 a 28 percent boost. We're granting experimental authorization for all-digital AM operation and improving protection to AM stations from potential re-radiators and/or pattern disturbances. And I am happy to confirm that this morning I circulated a Notice of Proposed Rulemaking, which will represent the next major step in the Commission's review of AM service, building on the work we have been doing over the last few years." She said the proposals in the Notice include "opening a one-time filing window, limited to current AM licensees and permittees, which will allow each to apply for one new FM translator station to fill in its service area." Clyburn concluded, "This proposed rulemaking invites comment on additional proposals or rule modifications that could help to revitalize the AM band. I am eager to hear all of the well-thought-out ideas that you can provide, and I know that my colleagues on the Commission are as well. It won't be easy. There will be challenges ahead. But working together, we can ensure that AM radio and all radio can flourish going forward, allowing your businesses to prosper while continuing to deliver tremendous benefits to the American people."



Michael Kassan Expands Advisory Role with Clear Channel

Clear Channel Communications announces that business strategist Michael Kassan will become a Special Advisor to Clear Channel's Chairman. Kassan is the Founder, Chairman and CEO of MediaLink, an advisory and business development firm that provides counsel and direction on issues of marketing, advertising, media, entertainment and digital technology. "His extensive background as a leader in the media and advertising industries includes serving as President/COO and Vice Chairman of Initiative Media Worldwide and President and COO of International Video Entertainment." Expanding on Clear Channel's current partnership with MediaLink, Kassan, will work closely with Clear Channel Chairman and CEO Bob Pittman, Clear Channel Media and Entertainment Chairman and CEO John Hogan, Clear Channel Outdoor CEO William Eccleshare and Clear Channel President and CFO Rich Bressler on "the further planning and implementation of strategic marketing and brand development for Clear Channel's businesses. Looks at Radio's Future in a Growing New Media World

"Because we are in Orlando, I want to mention David Peter Cradick - who touched millions of lives through his nationally-syndicated morning show, 'Kidd Kraddick in the Morning'," said NAB President and CEO Gordon Smith in opening remarks at the 2013 Radio Show produced by the NAB and the RAB. "Sadly, we mourned Kidd's loss in July... he was a man who had a special connection to Orlando. Each year, his charity, Kidd's Kids, sent terminally and chronically ill children to Disney World with their families. Kidd's listeners supported his charity, donating the funds to make these trips possible. The passing of Kidd, and sadly many other good friends in radio this year, reminds us of the power of this great medium… its connection to listeners… and its impact on communities." Smith segued from the remembrance of Kidd Kraddick to broadcasting's role in covering headlining tragedies. "Every day seems to bring a new story of broadcasters serving the public in times of crisis. Sadly, we experienced this earlier this week when a terrible tragedy occurred at the Navy Yard, not far from NAB headquarters in Washington DC. At times like this, we know we can turn to broadcast radio and television to help keep us safe. As broadcasters, we share the mission of serving our local communities - providing them with the news, emergency updates, and entertainment that they rely on each day. This mission keeps us focused on adapting to consumers' changing needs…so that radio will always be there when listeners need us…on any platform…anytime and anywhere." That served as a lead-in to comments on radio's future in a new media world.

"Indeed, radio's future lies with the listener, and we must keep looking forward in order to meet their needs. Unfortunately, many businesses are unable to think long-term, focusing instead on short-term gains to satisfy Wall Street… they seem only capable of concentrating on the here and now. But radio's success depends on having a long-term vision, too; and we must ask ourselves, what is that vision? What is the model that will enable us to grow our businesses and fulfill our mission as broadcasters at the same time? Many in this room are currently working to answer this question. There are those in the radio business who say streaming is our future. But are there other paths that can also move radio forward? Increasingly, webcasters are facing challenges as the music industry is pushing for more royalties for streaming music. It is my hope that both the streaming and broadcast platforms can have a business model that advances the interests of everyone with a stake in the music industry. Recent direct deals between broadcasters, record labels and artists demonstrate that there are market-based solutions. In thinking about radio's future, I am reminded of my Eagle Scout days. Every good scout is taught to leave the campground a little better than he found it; thus, improving the environment for the next group of campers. Now, if we apply that same principle to the radio business, we must ask ourselves, 'Are we positioning our companies to be better than we found them? What investments do we need to make in order to grow better businesses for future generations, and better places for investors to camp their dollars?' Investing in innovation is crucial to our long-term growth. Radio's future lies in our willingness to embrace new platforms and to go where listeners want to go. Now, to that end, NAB is continuing to work with the wireless industry and the government to promote a particular innovation that would greatly serve the public - the inclusion and activation of radio receivers in mobile devices."



RAB President/CEO Erica Farber Highlights 'Positive Energy'

In her opening remarks at the 2013 Radio Show, RAB President and CEO Erica Farber began by focusing on "the impact of positive energy across the industry." She also talked about radio advertising (the RAB's specialty), Professional Development programs, HD Radio, and streaming. "I've been at the RAB for a little more than a year and a half and during this time I have seen the impact of positive energy across the industry. Radio continues to be a healthy industry at $17.6 billion. Interestingly enough, it is still greater than some of the newer area of business like Online Video at $2.1 billion and Mobile at $2.9 billion. And unlike some other media, radio has taken an aggressive stand and taken advantage of technology to deliver content listeners want, in whatever format they want and when they want it. And advertisers recognize the importance of delivering their ad messages across all of radio's platforms including radio's fastest growing segment - Digital. Reaching a high of $767 million in 2012, Digital grew thirteen percent to $401 million by the first-half of this year - that's over eighty percent higher than the first half of 2009. Communications, Financial, Automotive, TV/Networks/Cable, and Restaurants continue to be radio's top spending categories. Radio has also realized growth from advertisers in mid-tier categories like Professional Services and Casinos. We need to continue to position radio to capture dollars from new categories as well as identify new dollars from existing advertisers. We have a great opportunity right now with consumer messaging regarding the Affordable Care Act, estimated to reach $1 billion by 2015 according to Kantar Media. Some of you have already taken a first step. Nearly five hundred people attended the RAB webinar last month focused on how to develop and uncover new and evolving revenue streams from the upcoming changes in healthcare legislation. And many of you attended today's session on Healthcare advertising as we learned what we need to do to capture our fair share.

"Our goal at the RAB is to provide the resources and information our members need today, tomorrow and long-term. Our successful CRM tool, Account Manager, has fifty-one hundred users, helping sales people and sales managers manage their businesses. Available on mobile devices and fully integrated with RAB research databases. Our Professional Development programs are created to benefit every level within your sales organization, from the entry level salesperson to the seasoned professional in the digital age. An average of two-thousand sales professionals each year have used RAB's online training and certification courses and we are pacing to have over three-thousand this year alone. Some of these certification courses deliver a deep dive into best practices of digital sales, as well as education and training to go from transactional seller to client-centric leader. Earlier this year, we launched a new member benefit - Finding Consumer Trends Report. Via online surveys to radio station data bases, the F.C.T. Report taps into consumer insights focused on specific ad categories to help you sell - both locally and nationally. Our first two were focused on Automotive and Shopping, and generated nearly fifty-thousand responses in total from radio station websites. On Friday, you will have the opportunity to hear first-hand the successes some stations have already experienced using this research. According to NPD Group's Annual Music Study, broadcast AM and FM radio stations are the still the top choice for both core and casual music fans. Specifically, ninety-five percent of music buffs tune into broadcast radio as their top choice for music content.

"Radio's positive momentum in delivering content, like news, music and information, across additional platforms and devices will continue as NextRadio hits the market. This hybrid radio takes broadcast radio's efficiency combined with interactive capabilities to create a content rich listener experience with new advertising opportunities. Since it's very recent launch, it has already been downloaded over twenty-five thousand time and over three-thousand stations have been tuned in coast-to-coast. We now have another exciting platform to take to our advertisers. And it should be noted that, according to Miller Kaplan data, the number one category spender in radio for the first half of this year is Communications /Cellular and the number eight in rank of overall top radio supporters for the second quarter was Sprint - who increased their support of our medium by one hundred and fifty three percent!

"HD Radio receivers are continuing to be added by automakers to more and more models. Did you know there are now over fourteen million HD receivers in the marketplace? Every six seconds over thirty percent of all new cars are driving off one of your client's car lots with an HD Radio! Thirty-three automakers have announced their plans to incorporate HD Radio technology in over one-hundred and seventy models by year-end with over eighty HD Radio receivers being included as standard equipment. The Streaming Initiative Committee, which you will be hearing more about in the coming weeks, is rolling up its sleeves and taking a deep dive look into all aspects of streaming - definitions, delivery, metrics, etc. And this will be important to radio's future especially as eMarketer projects that music listening via streams or downloads on smartphones will be used by thirty-three percent of the population or nearly one hundred and eight million people in 2017. As an industry we must speak with one voice to deliver one important message: commercial broadcast radio is nearly eleven-thousand strong. And the diversity in radio's programming is unquestionable. This medium allows marketers to reach their target audiences according to their lifestyles, interests, age groups and languages at any point in their day and most important closest to the moment they are about to make a purchase."



TuneIn Partners with Radio Disney

TuneIn announces a strategic partnership with Radio Disney which will enable listeners to hear Radio Disney anywhere in the United States, on over 200 platforms ranging from mobile phones and tablets, to smart TVs and cars. Says TuneIn CEO John Donham, "TuneIn strives to make the best content available to people regardless of where they are. With Radio Disney on TuneIn, millions of people can enjoy some of the Radio Disney best family friendly programming available, for free." Says Radio Disney VP/Programming and General Manager Phil Guerini, "TuneIn is one of the most innovative and user-friendly audio services. By aligning with TuneIn, we're not only able to offer our listeners a pioneering service, but also to broaden the reach of our stations even further, allowing more kids, tweens and families the chance to experience everything we have to offer."



Liquid Compass Launches Geofencing

Following beta testing, Liquid Compass launches its geofencing technology network-wide. The technology, we're told, enables broadcasters to permit or deny delivery of their online content to any combination of countries or DMAs. Streams using the technology "are evaluated by the most granular location data available for each connected device," reducing the "false positives" associated with IP-based location services. Liquid Compass has also developed a new synchronized terrestrial banner product, which lets broadcasters trigger display banners alongside their simulcast streams on all Liquid Compass mobile apps and desktop players, as well as other direct-link streaming devices, including in-vehicle systems that support album art over Bluetooth. "Liquid Compass understands how important it is to provide flexible solutions that adapt to the evolving landscape of streaming radio," says Liquid Compass SVP of Product and Technology Jaxon Repp. "As stations moved to adopt Arbitron’s new in-market simulcast standard, we identified the resulting unused companion banners as lost opportunity for our clients, and developed a solution to help them recapture that revenue. Our solution is designed to work out of the box with most automation systems, with a minimum impact on existing workflow." In a new beta, Liquid Compass is testing a geo-restricted subscription service. The service gives broadcasters the option of making their streams always available in certain countries and DMAs while setting a monthly subscription charge for listeners outside those areas. Liquid Compass COO Stephen Guillot tells us, "It is our intent to be as flexible as possible as our partners explore this new market. Whether it’s allowing out-of-market listeners access to the simulcast stream, replacing terrestrial ads with premium non-advertising content, or something new that one of our partners dream up next week, we’re here to make it happen."
